VILLA VALENTINA GENERAL RENTAL TERMS & CONDITIONS FOR OUR GUESTS (19 MAY 2022)
1. General applicability
1.1. Holiday home. These general rental terms conditions apply to reservations and agreements with regard to the holiday home Villa Valentina Bracciano standing and located at Via Settevene Palo Primo Tronco da Trevignano 34, 00062 in Bracciano RM, Italy.
1.2. Tenant. In these general rental terms and conditions, the term “tenant” is understood to mean: the person who concludes a rental agreement with us with regard to the rental of Villa Valentina.
1.3. Applicability of other terms. These general terms and conditions apply regardless of your (prior) reference to any own terms and conditions or to other general terms and conditions. We disclaim all terms and conditions to which you refer or which are used by you. Agreements deviating from these general terms and conditions are only valid if agreed in writing.
1.4. Contracting party. Your contractual partner is the company MHD Solutions (Dutch Chamber of Commerce Number: 08174406) (from now on referred to as ‘Villa Valentina’). The following booking terms and conditions shall apply to your booking.
2. Entering into a travel agreement
2.1. Booking. By making a booking you are submitting a reservation after which you will receive a booking confirmation. The booking only becomes final after the down payment is received. Ultimately 4 weeks before your arrival date and when the total rental amount has been paid, you will receive an information letter from us, with all relevant travel information.
2.2. Travel documents. All the travel documents will be sent to you by e-mail within 5 days after your booking, and will consist of the booking confirmation, these rental terms and conditions and the invoice. We request that you check these documents for correctness and notify us immediately of any inaccuracies.
2.3. Travelling party. Please note that you are responsible for the rest of the travelling party. This means that you need to ensure that you and the travelling party comply with the contractual commitments and behave as good guests.
2.4. Online offer. The information about Villa Valentina on our website has been compiled with the utmost care. Due to circumstances, the description or photos may differ slightly from the current situation. For example, the (outdoor) pool may be closed in winter, there may be a different couch in the holiday home or the bakery is slightly further away than anticipated. As long as these differences are not significant, we cannot be held accountable for this.
2.5. Mistakes/errors. We are not bound by a clearly recognisable mistake/error, such as price errors, e.g. as a result of printing or arithmetical mistakes or allocation errors in the internet.
2.6. Sublease/marketing. The subsequent renting out of Villa Valentina is not allowed and neither is the marketing as a trip organiser with its own pricing.
2.7. Special requests. We are happy to consider any guests requests when a booking is made. Please note, however, that Villa Valentina is unable to guarantee that such requests will be met. The villa, unfortunately, is not suitable for people in a wheelchair. Special requests as well as bookings made subject to conditions and verbal agreements shall only be valid in those cases in which they have been confirmed in writing by Villa Valentina.
3. Travel amount
3.1. Payment. The full travel amount should be paid by you in Euros, unless otherwise stated. The payment date is considered the date of crediting the bank account of Villa Valentina. When you make a payment in a different currency, you must account for the price difference due to the exchange rate.
3.2. Payment deadline. The down payment shall amount to 30% of the travel amount. It shall become payable immediately upon receipt of the booking confirmation. The booking is definitive only upon this payment. The payment of the remainder of the travel amount shall become payable no later than 4 weeks prior to arrival date. If bookings are made less than 4 weeks prior to arrival, the whole travel amount shall be payable immediately.
3.3. Late payment. If a down payment and/or final payment has not been received by the agreed due date, Villa Valentina will be entitled to withdraw from the travel agreement. Villa Valentina may charge the cancellation costs. After cancellation of the travel agreement, other guests will be able to book the villa and we can no longer guarantee you availability of the villa anymore.
3.4. Deposit and additional costs. For the rental of Villa Valentina a deposit of EUR 950 is required per booking. Furthermore a cleaning fee of EUR 225 per booking is charged. These amounts are due 4 weeks before the renting period together with the remainder of the rental costs. The deposit will be refunded at the latest two weeks after the end of the rental period, under the condition there are no damages or missing items.
4. Amendment, cancellation and termination
4.1. Amendment. Villa Valentina may make a minor amendment to your travel agreement, but we will always inform you about this. In the case of a more significant amendment, we will ask you whether you accept this or whether you prefer to cancel the booking. In the event you would like to amend the travel agreement, for instance by changing the date of arrival, we may charge you an amount which is equal to the cancellation costs, when the change is initiated within 6 weeks prior to the rental period.
4.2. Cancellation by Villa Valentina. Obviously, we do not want to disappoint you, but it can happen that we cancel your definitive booking on the first business day after your booking. In this case your deposit/payment will be reimbursed. Before the arrival date, Villa Valentina may also cancel the travel agreement if it is not reasonably practicable to fulfil the contract due to unavoidable and exceptional circumstances. In this case Villa Valentina shall forfeit its right to the full payment of the booking and refund the already paid amount.
4.3. Cancellation costs in the event of cancellation by the guest. The rent as stated on the invoice (‘rent’) and paid by you includes cancellation protection which permits you to cancel subject to the applicable cancellation terms and conditions as described below. You may cancel the booking at any time prior to the arrival date. We process cancellations during business days. If a cancellation reaches us after the end of a business day, we will process the cancellation within 2 business days. The next business day determines the cancellation costs. In case of cancellation within 8 weeks before the day of arrival, 25% of the rent will be incurred as cancellation cost. In case of cancellation within 4 weeks before the day of arrival, 50% of the rent will be incurred as cancellation cost. In case of cancellation from 1 week up to the day of arrival, 100% of the rent will be incurred as cancellation cost. If you have not arrived within 24 hours after the agreed arrival date without further notice, this will be considered a cancellation and 100% of the rent will be incurred as cancellation cost.
4.4. Refund after cancellation. Villa Valentina strives to refund the balance of the rental amount within 7 days from the cancellation date.
4.5. Termination for conduct-related reasons. Villa Valentina may terminate the rental agreement without observing a notice period if the guest persistently disrupts the stay, in spite of being warned to refrain from doing so, or if she conducts herself in breach of the contract to such an extent that the immediate cancellation of her contract is justified. This shall apply, for example, if other people are placed at risk. In this case the travel amount will be forfeited.
5. Stay
5.1. Upon arrival. The keys can be obtained by entering a code on a key box. Information about this will be provided in the information letter you will receive 4 weeks prior to the rental period. Directions to the villa are also included in the information letter. Inside the villa you will find a welcome letter and an information folder containing all information necessary for a pleasant stay.
5.2. Keys. The tenant is never entitled to duplicate any of the keys for whatever reason. Should the tenant do so, the tenant will owe a fine of EUR 500 without prejudice to the actual costs. The keys to Villa Valentina are on loan (lent) to the tenant by us. The keys remain our property. In the event of loss or theft or any other means of loss of the keys, the tenant owes an amount of EUR 100.
5.3. Check-in. Generally, you can check-in after 16:00 CET on the day of arrival. In case this is different for your stay, it will be indicated in your travel agreement. You must always enquire with Villa Valentina in advance if for whatever reason you expect to arrive on an alternative date. If you are unable to occupy the villa as agreed, as a result, for example, of very heavy traffic on the roads, or for personal reasons, and there are no unavoidable and exceptional circumstances at your destination, or in its immediate vicinity making it much more difficult for you to arrive on time, (as mentioned under clause 4), Villa Valentina shall be entitled to receive the payment pursuant to clause 4.3. The same shall apply if you leave the premises early.
5.4. Check-out. On your departure date as stated in the travel agreement, the villa must be vacated and handed over in a clean condition (see art. 5.5), i.e. the same condition as it was presented to you, no later than 10:00am CET. If you requested a different check-out time, which was confirmed by us, this adjusted check-out time will be stated in your travel agreement.
5.5. Basic cleaning. Prior to your departure, basic cleaning is to be carried out by you. The basic cleaning includes cleaning the kitchen surfaces, washing and drying the dishes and putting away the crockery, emptying the refrigerator and dishwasher, removing all the remaining food as well as all rubbish, stripping the beds, and sweeping or vacuuming all rooms so that the rented premises can be returned in a swept-clean condition, putting back all inventory to its original position and storing outside furniture pillows back into the pillow box. You can also find more detailed information in the information package you will receive from us 4 weeks prior to your arrival. If the basic cleaning is not done properly, Villa Valentina is entitled to charge the additional costs to you. After your departure the villa will be extensively cleaned by a cleaning as you were charged with on your invoice.
5.6. Help and assistance. Should you need urgent personal help or assistance during your stay, please contact us for information. The telephone numbers can be found in the travel documents or on our website.
5.7. Trusted tenant. The tenant, other users, and any member of your travelling party must behave as a good tenant during their stay in and around the house, and enjoy the villa and its facilities with the utmost care, like you would with your own home.
5.8. Damage. It may of course happen that you or your travelling party cause damage in or around the villa. Please report the damage as soon as possible to us, so that nobody will be confronted with surprises. In this case, you may be held liable for the damage. Any damages that are not covered by our insurance will be deducted from the deposit of EUR 950.
6. Special terms and instructions
6.1. Fixed and variable costs. Fixed costs which have to be paid in all cases, are included in the price set out on our website. Villa Valentina is a high end facility and does not want to surprise you with unexpected costs. Therefore variable costs (like energy charges, laundry of bed linen and towels, pellets for heating, etc.) are included in the rental charges.
6.2. Additional beds and/or cots. Villa Valentina has a standard bed configuration of three king size beds, each in a separate bedroom and 2 single beds in another bedroom. Additionally there are three chairs which can be converted to single beds and two cots including matrasses and bed linen. The 8 standard beds are made for every booking. Cots are generally suitable for children up to the age of 2. Additional beds and cots must always be ordered when a booking is made and confirmed by us.
6.3. Pets. Pets are not allowed at Villa Valentina. If pets are brought along without permission, Villa Valentina may insist that the animals concerned are removed. The right of termination to which Villa Valentina is entitled under clause 4.2 shall not be affected by the above.
6.4. Utilities. The use of water and electricity is included, but we kindly ask you to use this sparingly. Heating is available at Villa Valentina. Central heating is in the form of a wood pellet stove heating water in a boiler and the radiators and will need to be switched on/off by guests themselves. Information about how it can be switched on and off will be provided by us in the information letter 4 weeks prior to your arrival.
6.5. Internet/WiFi. Internet/WiFi is available at Villa Valentina. WiFi is generated through a modem connected to 4G/5G, and works generally very well. However, we cannot guarantee that it will be available all the time, nor guarantee speed, compatibility and security. As a result, you will be responsible for taking adequate security measures for your devices. Use may be restricted. Internet/ Use of the internet/WiFi is at the user’s own risk. Applicable laws must be observed when using internet/WiFi. In particular, you will be obliged to refrain from downloading files or accessing data containing material (e.g. films, music) protected by copyright but which are nevertheless illegally disseminated in the internet via file-sharing networks or similar. Likewise, you are not permitted to download files with criminal content or using illegal means. In the event that a culpable breach is committed, as stipulated in this text under the heading ‘Internet/WiFi’, you shall indemnify us from all third-party claims. The WiFi network is protected with a password that will be provided to you in the welcome letter.
6.6. Swimming pool. Villa Valentina has a swimming pool. The pool will generally be opened on the 1st of May and closed at the 30th of September each year. Please note, however, that the dates stated for the beginning and end of the season may be changed due to weather conditions.
6.7. High charging load. You are not allowed to use or plug in items with a high charging load such as, but not limited to, air conditioning, e-bikes and electric cars, unless otherwise stated in the travel agreement. Please be aware that there is no charger for an electric car available at Villa Valentina.
6.8. Smoking. Villa Valentina is a non-smoking holiday home. Smoking is only allowed outside, in the garden and on the terraces. An ash tray is available and we request you to use it all times and dispose the filters in the trash.
6.9. Open fire. No open fire may be used inside or outside the villa, except in the designated areas (barbecue or pizza oven). The fire place in the lounge area on the lower level of the villa may not be used. There is also a fire pit at the back of the garden, which may not be used either (this is reserved for the gardener).
6.10. Moving furniture. Moving the wardrobes and beds, as well as sound or television equipment or taking any part of the (indoor) inventory outside is expressly prohibited, with the exception of crockery/glasses and cutlery and any dining room chairs for your meal outside. The chairs convertible into beds may also be set up elsewhere, in order to create additional sleeping possibilities to your needs.
6.11. Maximum number of guests. Villa Valentina must not be occupied and used by a greater number of guests than confirmed in the booking confirmation. The maximum number of people stated also includes children and toddlers, unless otherwise agreed with Villa Valentina and confirmed in the booking confirmation. Overcrowding a rented property will entitle Villa Valentina to increase the rental on a proportional basis plus any additional costs retrospectively. The right of termination in clause 4 to which Villa Valentina is entitled will not be affected by the above.
7. Not as expected
7.1. Notification on site. In case Villa Valentina does not meet your expectations, please notify the us without delay. We may propose a suitable solution, provided this solution is reasonably achievable and does not involve excessive costs. If you fail to immediately notify us that Villa Valentina does not meet your expectations in the manner mentioned above, you shall lose your right of compensation.
7.2. Complaint. If the shortcoming is of such nature that it seriously impacts the remainder of your stay and it is not possible to find a solution or alternative, you have the option to terminate the travel agreement and, if applicable, you will be entitled to receive, at Villa Valentina’s sole discretion, a deduction of the travel amount or compensation. If Villa Valentina does not offer a suitable solution within a reasonable period of time, you are entitled to file formal complaint. We encourage you to file any complaints as soon as possible after your stay. Please note that any service providers (such as caretakers) are not party to the travel agreement and do not function as representatives of Villa Valentina, nor are they authorised to recognise claims and to submit and/or receive legally-binding declarations.
8. Liability and limitation of liability
8.1. Liability. The tenant and other members of the traveling party are fully, jointly and severally liable during the relevant rental period for all damage caused to the villa, the inventory and all items belonging to the rented object, unless the tenant and other users can demonstrate that the damage cannot be attributed to them. We therefore advise you to immediately inspect the inventory for defects upon your arrive at Villa Valentina, and if you notice damage or defects, please report them to us immediately, in accordance with clause 5.8 above.
8.2. Compensation for damages. If your stay is not in accordance with the travel agreement, you may be entitled to compensation for damages, unless the damages is attributable to the following causes: – culpable acts or failure on your part or on the part of a person travelling with you; – unforeseeable or unavoidable failure to perform by third parties; – unavoidable, exceptional circumstances.
8.3. Force majeure. External factors, force majeure, and special regional factors such as the presence of insects, stray dogs, inclement weather conditions or the condition of public roads will not entitle you to assert a claim against Villa Valentina.
8.4. Limitation of liability. The liability of Villa Valentina for damages arising from a breach of contractual duties or in relation to property damage shall be limited to the amount of the rent, except where it is not permissible to limit liability for claims for example for personal injury. Villa Valentina is not responsible for injuries caused by using our facilities, including the pool and the children’s playground.
9. Duty to claim timely
9.1. Time period. Your right to claim damages and/or compensation shall lapse after 3 months.
9.2. Start time period. The period of limitation referred to in clause 9.1 above shall commence on the last day of your stay as set out in the travel agreement.
10. Guest (contact) information
10.1. The information requested from you and your travelling party is required for the booking. Your information will not be used for any other purpose than to enable communication between the tenant and Villa Valentina, and to best serve your needs to make your stay unforgettable.
11. To avoid confusion
11.1. No business guest. Villa Valentina is a holiday home and is therefore not suitable for business travel.
11.2. Holiday. As Villa Valentina is intended for a holiday, you can rent it with us for a maximum period of 4 weeks.
11.3. Adults only. You can make a booking only if you are 18 years or older.
11.4. Youth groups. Villa Valentina is primarily intended for families. Therefore, groups that consist entirely of youths will not be admitted. As a general rule the term ‘youth’ refers to persons up to 25 years old, unless stated otherwise in the travel agreement. Bookings that are in breach of this will be cancelled and cancellation costs will be charged.
11.5. Parties, events and gatherings with invited guests. The holiday home is intended for you and your travelling party. It is not permitted to organise parties or events with invited guests other than persons from the travelling party. You are allowed to welcome visitors as long as it fits within the reasonable capacity of the villa, and does not cause any disturbance to the environment. If this is not adhered to, we will terminate the travel agreement and charge costs including, if applicable, cleaning costs and damages.
11.6. Additional travel services. In the event that you book an additional travel service with a third party via a link or advised on our website, this additional travel service does not form part of your travel agreement with Villa Valentina.
11.7. Applicable law. Dutch law will apply to all bookings and travel agreements.
11.8. Individual provisions. Should individual provisions in the travel agreement be void, this shall not result in the travel agreement as a whole becoming void.
12. Regulations governing passports, visas, health, customs and foreign currency
12.1. Compliance. As the guest, you are personally responsible for complying with the regulations in force for the countries governing entry and exit, as well as health regulations, passport and visa regulations, etc. The embassies/consulates in the countries you will be visiting can also provide you with information. All fines accrued by you as a result of failure to comply with these regulations, in particular the payment of cancellation costs, shall be your responsibility, unless they are the result of having been supplied with false or insufficient information by Villa Valentina.
